Description

There are several legal principals all collection professionals should be familiar with to effectively represent and satisfy their clients' claims. A basic understanding of these principals is necessary to negotiate, facilitate payment, and obtain authorization from clients for authority to settle or sue. 

Principals to be discussed during this seminar include: 

  • creditor’s legal position to sue
  • debtor’s business composition and liability of principals
  • statute of limitations
  • law of contracts
  • applicable state statutes (UCC)
  • judgment enforcement remedies
  • FDCPA as it applies to commercial claims, and more!

Your speakers are:

Marc Lichtman


Marc S. Lichtman, is an Attorney licensed to practice law in the states of Illinois and Florida.  He was admitted to practice law in Illinois in 1985 and graduated from the DePaul University College of Law.  In 1989, Marc S. Lichtman earned an LL.M. transaction in taxation. 

 

Marc S. Lichtman was a 1980 graduate of the Indiana University School of Business earning a double major in Real Estate and Finance.  At Indiana, he obtained the educational background to analyze businesses, transactions and financial records.  After college, Marc S. Lichtman worked for the Federal Reserve Bank of Chicago as a Bank Holding Company Examiner where he honed his ability to review and analyze financial statements and company books and he appraised real estate. 

 

After law school, Marc S. Lichtman worked in various law firms handling real estate and business transactions and commercial litigation.  He was able to use his LL.M. Degree in Taxation, Business Degree concentrating in Real Estate and Finance and his experience from working at the Federal Reserve Bank of Chicago to aggressively represent clients in both a transactional and litigation settings.   He has found his background to be very helpful in the post judgment collection area to find improperly transferred assets or schemes to defraud creditors. 

 

Marc S. Lichtman has held public office as the Chairman and Board Member of the City of Highland Park Zoning Board of Appeals. 

 

Marc S. Lichtman has graduated from the National Institute of Trial Advocacy Trial Skills Program and Deposition Skills Program and has attended their seminar on Expert Witnesses.  Currently, he is a member of the Legislative Committee of the International Association of Commercial Collectors. 

 

Outside of the law practice, Marc S. Lichtman interests are restoring vintage bicycles, cycling, reading, comedy and anything related to Agent 007—James Bond. 

Kara Eisen

Kara R. Eisen is a Cleveland, Ohio native and earned her Bachelor of Arts, cum laude, in Psychology from Miami University. Kara earned her Juris Doctor from DePaul University.

Prior to joining Lichtman Eisen Partners, Ltd., she worked for a national collection firm where she managed a high-volume caseload while representing financial institutions and debt buyers in litigation of cardholder agreements, retail installment contracts, notes and mortgages. Kara then went onto work for a union side labor law firm where she represented employee benefit funds and labor unions in the collection of outstanding pension contributions and union dues.

Kara’s practice is concentrated primarily in commercial litigation in which she represents businesses and financial institutions relating to breach of contract, fraud, unpaid insurance premiums and insurance audits. Kara is skilled in representing judgment creditors in post-judgment proceedings, including, citations to discover assets, wage garnishments, and bank attachments. Kara also has experience in commercial mortgage foreclosures, as well as representing creditors in Chapter 7 and 13 bankruptcy cases as well as representing clients in preference claims. Kara enjoys the challenges involved in commercial litigation and collections.
